Terms of Service
Effective May 2, 2026
These Terms of Service (“Terms”) govern your use of Trace (the “Service”), operated by Salman Khurshid (sole proprietor) (“Trace,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Trace is a payment-attribution analytics tool. We ingest events from a JavaScript pixel installed on your website and join them to charges in your connected Stripe account, producing per-channel revenue, customer-acquisition-cost, and return-on-ad-spend reports. The Service is offered on a software-as-a-service basis at tracerev.com.
2. Eligibility and account
You must be at least 18 years old and authorized to bind any business you represent. You are responsible for keeping your magic-link login email secure and for all activity under your account. Notify us immediately at support@tracerev.com of any unauthorized use.
Each account is for a single business entity. You may add multiple sites and multiple Stripe Connect integrations under one account.
3. Subscription, fees, and payment
- Plan: Standard at $99 USD per month, recurring monthly. Single tier.
- Trial: New accounts begin with a 7-day free trial. No credit card is required to start the trial.
- Founder pricing: The promotion code FOUNDER50 grants a 20% lifetime discount ($79 USD/month) and is limited to the first 50 redemptions.
- Billing: Subscriptions auto-renew at the end of each billing period. Charges are processed by Stripe.
- Cancellation: You may cancel at any time from the Account page. Cancellation takes effect at the end of the current billing period; you retain access until that date.
- Refunds: Fees are non-refundable except where required by law. We do not pro-rate partial-month refunds for cancellation.
- Price changes: We may change subscription prices on 30 days’ notice. Customers paying with FOUNDER50 keep the discounted rate as long as the subscription remains active.
- Taxes: Fees are exclusive of taxes. You are responsible for any sales, use, VAT, or similar taxes payable on your subscription.
4. Customer data
You retain all rights, title, and interest in the data you provide to the Service or that the Service collects on your behalf via the pixel and Stripe Connect integration (“Customer Data”). You grant us a limited license to use Customer Data solely to provide and improve the Service.
You are responsible for ensuring that you have all necessary rights, consents, and disclosures to allow us to process Customer Data on your behalf, including providing your end users with a privacy policy and obtaining any required consent under applicable laws.
5. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or attempt to access the Service’s source code or infrastructure beyond the public API
- Send malicious code, attempt to overwhelm or disrupt the Service, or evade rate limits
- Use the Service to track end users in violation of applicable privacy laws
- Resell, sublicense, or white-label the Service without our written agreement
- Use the Service for unlawful purposes or to process unlawful content
6. Intellectual property
The Service, including its software, design, documentation, and all related materials, is the exclusive property of Trace and protected by copyright and other laws. We grant you a non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
Feedback you provide may be used by us to improve the Service without obligation to you.
7. Service availability
We aim for high availability but do not commit to a specific uptime percentage. The Service is provided on a best-effort basis. We may schedule downtime for maintenance and will provide reasonable notice when feasible. We are not liable for downtime caused by third parties (Vercel, Supabase, Stripe, the public internet) or events outside our reasonable control.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ATTRIBUTION RESULTS WILL EXACTLY MATCH ANY OTHER SYSTEM. ATTRIBUTION IS DETERMINISTIC GIVEN THE INPUT DATA, BUT WE DO NOT GUARANTEE THAT THIRD-PARTY SYSTEMS (AD PLATFORMS, ANALYTICS TOOLS) WILL AGREE WITH OUR RESULTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACE’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED US DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on certain damages. To the extent any provision of this section is unenforceable in your jurisdiction, the remaining provisions remain in effect.
10. Indemnification
You agree to indemnify and hold harmless Trace from any claim arising out of (a) your use of the Service in violation of these Terms, (b) your violation of any law or third-party right, or (c) Customer Data you provide that infringes any third party’s rights.
11. Termination
You may terminate your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay fees, or use the Service in a way that creates legal or operational risk for us. On termination, we will delete Customer Data within 30 days, except as required to retain by law (e.g., billing records).
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email and by updating the effective date at the top of this page at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. 14. General
- Entire agreement: these Terms, together with our Privacy Policy, are the entire agreement between you and Trace.
- Severability: if any provision is unenforceable, the remaining provisions remain in effect.
- No waiver: our failure to enforce a provision is not a waiver.
- Assignment: you may not assign these Terms without our consent. We may assign in connection with a merger or sale.
- Force majeure: neither party is liable for delays caused by events beyond reasonable control.
